Aqua Kids Waiver

Acknowledgement of Risk, Waiver and Release of Liability

I, the undersigned parent or legal guardian, acknowledge that swimming, swimming lessons, aquatic activities, and being in or around a swimming pool involve inherent risks. These risks may include, but are not limited to, slips and falls, collisions, physical injury, water-related injury, drowning, and other accidents that may occur despite reasonable safety precautions and supervision.

I voluntarily permit the participant named on this registration form (“Participant”) to take part in programs and activities offered by Aqua Kids Swim School Inc. and acknowledge and accept the inherent risks associated with participation.

Release and Waiver

To the fullest extent permitted by applicable Ontario law, I agree to release and hold harmless Aqua Kids Swim School Inc, its owners, directors, employees, instructors, contractors, representatives and agents, together with the owners, operators, employees and representatives of any swimming pool or facility where Aqua Kids Swim School Inc. programs are conducted (collectively, the “Released Parties”), from claims for injury, loss or damage arising from or connected with the Participant’s involvement in the swim program or presence at the facility, including claims arising from the inherent risks associated with swimming and aquatic activities.

This acknowledgement and release also applies, to the extent permitted by law, to risks and claims relating to a parent, guardian or spectator accompanying the Participant while attending an Aqua Kids Swim School Inc. program or using the facility in connection with the program.

Nothing in this agreement is intended to waive or exclude any right or liability that cannot legally be waived or excluded under the laws of Ontario.

Parent/Guardian Acknowledgement

By signing or electronically accepting this registration form, I confirm that:

I am the Participant’s parent or legal guardian, or I otherwise have legal authority to provide this consent;

I have provided Aqua Kids Swim School Inc. with relevant information concerning the Participant that may affect their safe participation in swimming lessons;

I understand that I am responsible for following Aqua Kids Swim School Inc. and facility safety rules and ensuring that the Participant follows instructions provided by instructors and facility staff;

I have read and understood this Acknowledgement of Risk, Waiver and Release of Liability; and I voluntarily consent to the Participant’s participation in Aqua Kids Swim School Inc. programs.
